Refund & cancellation policy

1. Scope of this policy
This policy applies to all paid engagements with Orbator Ventures Private Limited ("Orbator", "we", "us"), including productised services, custom projects, engineering retainers, and any associated subscription billing. It governs both Indian and international clients.
2. Right to a refund
2.1 Productised services and discovery sprints
You are entitled to a 100% refund if you request cancellation within seven (7) calendar days of the payment date and work has not yet started. "Work has not yet started" means we have not held the kick-off call, scheduled stakeholder interviews, or written any artefact specific to your engagement.
Once work has started, fees paid for completed phases are non-refundable. Where a phase is in progress, we issue a pro-rated refund for the un-delivered portion of that phase at our sole determination.
2.2 Engineering retainers (subscription billing)
Retainer fees are billed monthly in advance. If you cancel within seven (7) calendar days of the start of a new billing cycle and no senior engineering hours have been consumed in that cycle, we refund the cycle in full.
If hours have been consumed, we pro-rate the refund based on hours delivered against the tier's hour allocation. Subsequent billing cycles do not begin once a cancellation is recorded.
2.3 Custom projects (milestone billing)
For projects invoiced against signed milestones, fees paid for completed and accepted milestones are non-refundable. The next milestone may be cancelled by either party with seven (7) days written notice; any pro-rata work completed up to that date is invoiced or refunded against the milestone in proportion to delivery.
3. How to cancel
Email hello@orbator.in from the address on record. Cancellations are accepted 24 hours a day, 7 days a week. Your message must include:
- The engagement reference (or invoice number) you are cancelling.
- The reason for cancellation (helps us improve; not required).
- The bank or card account to refund to, if different from the original payment method.
We acknowledge your cancellation within two (2) business days and confirm whether and how much refund applies under section 2.
4. How refunds are issued
Refunds are processed to the original payment method wherever possible. Typical timelines once confirmed:
- Razorpay card refunds: 5–7 business days to reach your statement.
- UPI: 1–3 business days.
- Net banking and IMPS: 5–7 business days.
- Stripe / international cards: 5–10 business days.
- SWIFT wire reversal: 7–15 business days, subject to intermediary bank charges that are passed on.
Where the original method is unavailable (closed card, lapsed authorisation), we issue a bank transfer to an account you nominate in writing.
5. Non-refundable items
The following are not eligible for refund under any circumstances:
- Third-party costs we have already paid on your behalf and cannot recover (App Store / Play Store fees, paid SDK licences, third-party API charges).
- Time spent on cancelled discovery work where deliverables have been shared with you.
- Engagements terminated by us for cause — material breach of the engagement agreement, unlawful instructions, or non-payment of a subsequent invoice.
6. Chargebacks
We ask that you raise any concern with us first by email at hello@orbator.in before initiating a bank chargeback. We respond within two (2) business days and almost always resolve disputes faster than the chargeback process. Frivolous or fraudulent chargebacks (those raised without first contacting us, or for engagements where deliverables have been accepted) may be contested with evidence.
7. International payments
For clients outside India, refunds are processed in the original currency where possible. If a currency conversion is required by the intermediary bank, the prevailing exchange rate and any wire charges applied by the intermediary or correspondent bank are borne by the party requesting the refund.
8. Subscription auto-renewal
Retainer subscriptions auto-renew on the same calendar day each month unless cancelled. You receive a renewal reminder email five (5) days before each charge. You may turn off auto-renewal at any time by emailing us; the current cycle continues until its end date, and no further charges are taken.
9. Disputes
Any dispute relating to a refund or cancellation that cannot be resolved by email is referred to mediation in good faith. Failing mediation, the dispute is subject to the exclusive jurisdiction of the courts at Malappuram, Kerala, India, notwithstanding the client's location.
10. Changes to this policy
We may update this policy. The version published at this URL is the one applicable to your engagement at the time we received your payment. Material changes affecting active engagements are notified to you by email at least thirty (30) days before they take effect.
